29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: For employees working in the fabrication area they were over exposed to noise levels over 85 decibels for the OSHA TWA, as observed on or about February 11, 2020: a) For the employee exposed to noise at 66% dose of the permissible daily noise exposure limit (8-hour time-weighted-average level 0f 85 dBA), or an equivalent sound level of 88.1 dBA for the 411 minute sampling period. This exposure calculation included a zero increment for the 57 minutes not sampled. b) For the employee exposed to noise at 60% dose of the permissible daily noise exposure limit (8-hour time-weighted-average level 0f 85 dBA), or an equivalent sound level of 87.6 dBA during the 400 minute sampling period. This exposure calculation included a zero increment for the 60 minutes not sampled.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (a) For employees fabricating Carbon and Alloy Steel Rebar at the production bay, as noted on or about 01/02/2020. No written hazard communication program was in place for employees cutting, bending and bundling rebar containing metal such as but not limited to lead, manganese and iron.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (a) For employees fabricating Carbon and Alloy Steel Rebar at the production bay, training was not conducted on the hazards associated to rebar which amongst other compounds contains lead, chromium and manganese, as observed on or about January 02, 2020.
