OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards:  a)  At 3206 Dolphin Drive., Lot 44 Laguna Key, Gulf Shores, Alabama:  On or about January 8, 2020 and at times prior; the employer exposed employees to fall of up to 8 feet  in that employees were allowed to work off of a sheet of plywood elevated by a powered industrial truck without fall protection.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crush hazards:  a)  At 3206 Dolphin Drive., Lot 44 Laguna Key, Gulf Shores, Alabama:  On or about January 8, 2020 and at times prior; the employer failed to require and enforce the use of seat belts for all employees operating powered industrial trucks on site exposing his employees to struck-by and crush hazards from being thrown from the lift.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  At 3206 Dolphin Dr., Lot 44 Laguna Key (Roof), Gulf Shores, Alabama:  On or about January 8, 2020 and at times prior; the employer allowed his employees to perform roof decking activities without fall protection exposing his employees to a fall hazard of 32 feet 6 inches to the ground below.  b)  At 3206 Dolphin Dr., Lot 44 Laguna Key (Rear Porch Second Level), Gulf Shores, Alabama:  On or about January 8, 2020 and at times prior; the employer allowed his employees to perform framing activities without fall protection exposing his employees to a fall hazard of 23 feet 6 inches to the ground below.  c)  At 3206 Dolphin Dr., Lot 44 Laguna Key (Roof Trusses), Gulf Shores, Alabama:  On or about January 8, 2020 and at times prior; the employer allowed his employees to perform roof decking activities without fall protection exposing his employees to a fall hazard of 10 feet to the ground below.
