29 CFR 1910.147(c)(1): The employer did not establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.   a.) On or about February 27, 2020 at the yard and bag plant, the employer failed to implement and maintain a written program consisting of employee training and inspections, exposing employees performing servicing and/or maintenance on machines such as, but not limited to, the industrial wood grinder to struck-by, caught-in and electrical hazards.

On or about February 27, 2020, at the bag plant, work rests were not adjusted to within 1/8-inch of the wheel on the ACE 6" Dual Light Bench Grinder, exposing employees to a struck-by hazard.

29 CFR 1910.215(b)(9): Exposure adjustment. Safety guards of the types described in Subparagraphs (3) and (4) of this paragraph, where the operator stands in front of the opening, shall be constructed so that the peripheral protecting member can be adjusted to the constantly decreasing diameter of the wheel. The maximum angular exposure above the horizontal plane of the wheel spindle as specified in paragraphs (b)(3) and (4) of this section shall never be exceeded, and the distance between the wheel periphery and the adjustable tongue or the end of the peripheral member at the top shall never exceed one-fourth inch.    a.) On or about February 27th, 2020, at the bag plant, the tongue safety guards on the ACE 6" Dual Bench Grinder  were not within 1/4-inch of the wheel, exposing employees to a struck-by hazard created at the point of operation.

Where the drive extends over other machine or working areas, protection against falling shall be provided. This subparagraph does not apply to manually operated sprockets.  a.) On or about February 27, 2020, the employer in the yard did not have enclosure on the sprocket and chain, which were not above seven (7) feet from the ground.
