29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system: (a) Apartment Building #5 located at 104 Rolling Hills Drive, West gable side: On or about 01/08/2020, and at times prior, the employer exposed employees to fall hazards of up to 15-feet, 6-inches to the lower level, in that a fall protection system was not provided to employees using a ladder jack scaffold plank engaged in vinyl siding activities.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) Apartment Building #5 located at 104 Rolling Hills Drive, West gable side and lower roof: On or about 01/08/2020, and at times prior, the employer exposed employees to fall hazards of up to 7-feet, 10-inches to the lower level, in that a fall protection system was not provided to employees engaged in siding work using the 6/12 pitched roof as a walking/working surface to access the ladder jack scaffold.
