29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. (a) On or about January 10, 2020 at the construction site located near 12705 W. Bluemound, Brookfield, WI, employees of TelCom Construction LLC were exposed to cave-in while working on some damaged drain pipes in an unprotected excavation. The competent person did not remove employees with water accumulating in the bottom in the excavation which was also lacking cave-in protection.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). (a) On or about January 10, 2020 at the construction site located near 12705 W. Bluemound Ave, Brookfield, WI, employees were performing work in an approximately 6- 5/10 feet deep excavation without adequate cave-in protection, there by exposing employees to a struck-by / crushing hazards.
