29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling by a guardrail system, safety net system, travel restraint system or personal fall arrest system: Employees were exposed to fall hazards. On or about January 9, 2020, employees engaged in production activities at the Pawnee Rock laydown yard were exposed to fall hazards of approximately 15 feet from the walking / working surface of the machine head to the ground below. Employees were exposed in that a fall protection was not provided.

29 CFR 1910.178(q)(7): Industrial trucks were being placed in services after the examination showed condition(s) adversely affecting the safety of the vehicle: Employees were exposed to struck-by hazards. Employees engaged in material handing activities using the Kalmar forklift, serial number A4020041, located at 8815 8th St Great Bend Kansas, were exposed to struck-by hazards in that the forklift was not taken out of service when it was found to be unsafe and in need of repair. The tires were damaged, with chunks missing.
