On or about August 9, 2019 and prior to that time there was no frequent and regular inspection program being maintained in use by a competent person to ensure the job site materials and equipment such as roof deck steel erection activities associated with metal standing seam roof decking removal and reinstallation fall protection devices and or systems were being maintained and utilized exposing employees to include one less than 18 years of age to fall potentials in excess of 31 feet.

29 CFR 1926.502(a)(2): Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection. On or about August 9, 2019 and prior to that time located on the auditorium roof deck, steel erection activities associated with metal standing seam roof decking removal and reinstallation was being performed by employees to include one less than 18 years of age without the use of conventional fall protection systems being provided and installed by the employer before employees began the work that necessitated the fall protection exposing employees to fall potentials in excess of 31 feet.

29 CFR 1926.760(d)(1): Guardrail systems, safety net systems, personal fall arrest systems, positioning device systems and their components shall conform to the criteria in �� 1926.502 (see Appendix G to this subpart). On or about August 9, 2019 and prior to that time located on the auditorium roof deck, steel erection activities associated with metal standing seam roof decking removal and reinstallation was being performed by employees to include one less than 18 years of age without the use of conventional fall protection systems and their components conforming to 1926.502 criteria in that conventional fall protection systems were not being provided and installed by the employer before employees began the work that necessitated fall protection exposing employees to fall potentials in excess of 31 feet.

29 CFR 1926.760(a)(1): Except as provided by paragraph (a)(3) of this section, each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level shall be protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems. On or about August 9, 2019 and prior to that time located on the auditorium roof deck, steel erection activities associated with metal standing seam roof decking removal and reinstallation was being performed by employees to include one less than 18 years of age without the use of conventional fall protection exposing employees to fall potentials in excess of 31 feet.

On or about August 9, 2019 and prior to that time located on the auditorium roof deck, steel erection activities associated with metal standing seam roof decking removal and reinstallation was being performed by employees to include one less than 18 years of age without the use of conventional fall protection exposing employees to fall potentials in excess of 31 feet who were not trained or knowledgeable of the fall protection regulation requirements of Subpart R or procedures to minimize those hazards.
