29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s) (a) Warehouse - On January 14, 2020, the employer failed to ensure that all powered industrial trucks that were found to be in need of repair or were in anyway unsafe were removed from service until they had been restored to a safe operating condition. The sit down Toyota forklift was not removed from service after it was found that the brake pedal was damaged. In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase, or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.178(l)(6): The employer did not certify that each operator has been trained and evaluated as required by this paragraph (l): (a) Warehouse - On January 14, 2020, the employer did not certify that each forklift truck operator had been evaluated as required by paragraph (l), with certification records that includes the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the evaluation. In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
