29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a) YADAICELA GENERAL CONSTRUCTION LLC, located at Lot 1962 Peacock drive, Sunbury, OH 43074: On and preceding January 14, 2020, the employer did not instruct employees in the recognition and avoidance of unsafe conditions and the procedures to be followed in order to minimize these hazards. Framers were installing walls and wood decking on the second floor of a home that varied from 14 feet with the employees working at different levels. The employees were not utilizing proper eye or fall protection, which exposed them to falls up to 14 feet and struck by hazards to the eyes.

Framers were installing joists and wood decking using a pneumatic nail gun and a circular saw to cut the pieces. The employees were not utilizing eye protection, which exposed them to struck by hazards to the eyes.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a) YADAICELA GENERAL CONSTRUCTION LLC, located at Lot 1962 Peacock drive, Sunbury, OH 43074: On and preceding January 14, 2020, the employer did not ensure that employees engaged in residential construction activities 6 feet or more above lower level were protected from falls. Framers were installing joists and wood decking on the second floor of a home from 14 feet above the ground below. The employees were not utilizing any form of fall protection, which exposed them to falls up to 14 feet.
