29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a) Salvador Ortiz, located at Lot 59, 5256 Meadowsview Lane, Hilliard, OH 43026: On and preceding January 14, 2020, the employer failed to initiate and maintain a safety and health program such as but not limited to a personal protective equipment program, electrical safety program, and a fall protection program for employee conducting framing work.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.   a) Salvador Ortiz, located at Lot 59, 5256 Meadowsview Lane, Hilliard, OH 43026: On and preceding January 14, 2020, the employer did not instruct employees in the recognition and avoidance of unsafe conditions and the procedures to be followed in order to minimize these hazards. Employees were exposed to multiple fall hazards of up to 11 feet 8 inches, electrical contact hazards, and struck-by hazards while conducting framing work.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.   a) Salvador Ortiz, located at Lot 59, 5256 Meadowsview Lane, Hilliard, OH 43026: the employer did not ensure employees wore safety glasses while utilizing power tools that presented struck-by hazards to the eyes and face. Framers were installing lumber while using a pneumatic nail gun and a circular saw to cut the pieces. The employees were not utilizing eye protection, which exposed them to struck by hazards to the eyes.

29 CFR 1926.405(g)(2)(iv): Strain relief. Flexible cords shall be connected to devices and fittings so that strain relief is provided which will prevent pull from being directly transmitted to joints or terminal screws.  a) Salvador Ortiz, located at Lot 59, 5256 Meadowsview Lane, Hilliard, OH 43026: the extension cord used to provide electrical power from the temporary receptacle to the circular saw had the strain relief clamp pulled away from the jacket of the cord, on both ends of the cord, allowing the pull to be directly transmitted to the interior connections. The cord was used to provide 125 volt electrical power to a circular saw that was used by employees conducting framing work.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a) Salvador Ortiz, located at Lot 59, 5256 Meadowsview Lane, Hilliard, OH 43026: On and preceding January 14, 2020, the employer did not ensure that employees engaged in residential construction activities 6 feet or more above lower level were protected from falls. Framers were installing a microlam beam while standing on the top plate of an exterior wall of a home from 11 feet 8 inches above the ground below. The employees were not utilizing any form of fall protection, which exposed them to falls up to 11 feet 8 inches.    b) Salvador Ortiz, located at Lot 59, 5256 Meadowsview Lane, Hilliard, OH 43026: On and preceding January 14, 2020, the employer did not ensure that employees engaged in residential construction activities 6 feet or more above lower level were protected from falls. Framers were working on the first floor where the stairway opening to the basement was unguarded. The employees were not protected from falls, which exposed them to falls of 9 feet 3 inches.
