OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed a struck by hazard: On or about 1/16/2020, at Custom Built Marine Construction Inc. worksite located at 915 Cordova Road, Fort Lauderdale, FL 33326. An employee was exposed to a struck by hazard while directing traffic on a public road without wearing a high-visibility vest.

A front end loader (i.e. Komatsu WA270-7, Serial number 80562) equipped with a boom attachment was loaded over its capacity while pulling piles out of water, exposing employees to struck by and drowning hazards.

29 CFR 1926.106(a): Employees working over or near water, where the danger of drowning exists, shall be provided with U.S. Coast Guard-approved life jacket or buoyant work vests: On or about 1/16/2020, at Custom Built Marine Construction Inc. worksite located at 915 Cordova Road, Fort Lauderdale, FL 33326. Employees working over and near water were not wearing a personal flotation device, exposing them to a drowning hazard.
