29 CFR 1926.602(d) NOTE: The requirements applicable to construction work under this section are identical to those set forth at 29 CFR 1910.178(l) of this chapter. 29 CFR 1910.178(l)(6): The employer did not certify that each operator has been trained and evaluated as required by this paragraph (l), with certification records that include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation: a) On or about January 14, 2020, the employer failed to certify, as required by the standard, that each powered industrial truck operator had been trained and evaluated to operate powered industrial trucks, including the Multiquip Whiteman Series track-drive power buggy, Multiquip Whiteman Series power buggy, and Canycom Off-road Rubber Track Dumper.
