29 CFR 1926.501(b)(1): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  (a)Rushmore Construction Company at 1800 LeMay Boulevard, Ellsworth, AFB 57706: On or about and at times prior to January 15, 2020, the employer did not ensure that employees installing a snow guard on a roof were protected from fall hazards. Employees were working near the edge of the roof without a fall protection system in place. This condition exposed employees to a fall hazard of approximately 12 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   (a)Rushmore Construction Company at 1800 LeMay Boulevard, Ellsworth, AFB 57706: On or about and at times prior to January 15, 2020, the employer did not ensure that each employee engaged in snow fence installation on the roof of commercial building, had been trained to recognize the hazards associated with working at elevations over 6'. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. The employer did not provide training regarding personal fall arrest systems and an employee was using the top of an extension ladder as an anchorage. The condition exposed employees to the hazard of falling from an elevation of approximately 12 feet.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards:   (a)Rushmore Construction Company at 1800 LeMay Boulevard, Ellsworth, SD 57706: On or about and at times prior to January 15, 2020, the employer did not ensure a training program that each employee utilizing ladders had been trained to recognize the hazards associated with working with extension ladders. The program shall enable each employee to recognize the hazards and shall train each employee in the procedures to be followed in order to minimize these hazards. The condition exposed employees to the hazard of falling from an elevation of approximately 12 feet.   Abatement Note:  The employer shall ensure that each employee has been trained by a competent person in the following areas, as applicable:     (a)        The nature of fall hazards in the work area;     (b)        The correct procedures for erecting, maintaining, and disassembling the fall protection systems to be used;     (c)        The proper construction, use, placement, and care in handling of all stairways and ladders;     (d)       The maximum intended load-carrying capacities of ladders; and     (e)        The standards contained in this subpart.
