29 CFR 1910.28(b)(3)(i): The employer did not ensure that each employee was protected from falling through any hole (including skylights) that were 4 feet (1.2 m) or more above a lower level. a) 1101 Lambson Lane New Castle, DE - On or about January 18, 2020, the employer failed to properly cover a floor opening in the area of the sort line were multiple employees work in sorting recyclable materials. An employee fell from an elevation of approximately 15 to 20 feet above grade through the floor hole when the pallet covering it failed.

29 CFR 1910.219(d)(1): Pulley(s) with part(s) seven feet or less from the floor or work platform were not guarded in accordance with the requirements specified in 29 CFR 1910.219(m) and (o): a) Revolution Recovery Delaware, LLC. - On or about January 28, 2020, the employer failed to guard the drive pulley on the feed conveyor which is approximately 6 feet above ground level, exposing employees to laceration crushing and amputation hazards who are working in the affected area. This conveyor is located in the sorting area of the facility which is above grade. b) Revolution Recovery Delaware, LLC - On or about January 28, 2020, the employer failed to properly guard the drive pulley on the fines takeaway conveyor located at the entrance of the facility at ground level which leads to the sorting area of the facility.
