29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets. (a) On or about January 22, 2020, the employer had not trained employees about the hazardous chemicals in their work area. These chemicals included, but were not limited to Superior Bronze Polyester Knife Grade (flammable, dermal irritant, carcinogenic), quartz (carcinogenic), and granite (carcinogenic) while manufacturing quartz and granite countertops. The Unity Granite & Cabinet, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.1200(h)(1), which was contained in OSHA inspection number 1406120, citation number 1, item number 4b and was affirmed as a final order on October 1, 2019, with respect to a workplace located at 6537 Dixie Hwy., Fairfield, OH 45014.

The Unity Granite & Cabinet, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.132(d)(2), which was contained in OSHA inspection number 1406120, citation number 2, item number 1 and was affirmed as a final order on October 1, 2019, with respect to a workplace located at 6537 Dixie Hwy., Fairfield, OH 45014.

29 CFR 1910.1053(d)(3)(iii): Where the most recent exposure monitoring indicates that employee exposures are at or above the action level but at or below the PEL, the employer shall repeat such monitoring within six months of the most recent monitoring. a) On or about January 22, 2020, the employer had not conducted repeat monitoring within 6 months of the most recent monitoring where exposures to respirable crystalline silica were above the action level. The previous monitoring was performed on June 7, 2019 and employees were found to be exposed to an 8 hour time-weighted average of 30 and 31 micrograms per cubic meter of air, which exceeded the action level of 25 micrograms per cubic meter of air.
