29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns. At the jobsite, employees were not wearing hardhats while working below other employees that were installing decking material to a residential house, exposing employees to struck-by hazards from falling objects.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest system. At the jobsite, employees performing decking activities on the roof were not provided fall protection and exposed to an unprotected fall hazard at a height of over 6 feet to the ground below. Victor Rodriguez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1456855, Citation Number 1, Item number 1, and was affirmed as a final order on April 7, 2016, with respect to a workplace located at 4521 Carmel Drive, Rowlett, Texas 75088.
