29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed; the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder: (a) On or about January 21, 2020, at least one employee roofing an apartment was using a ladder with its top approximately one foot above the upper landing thereby exposing the employee using it to a fall hazard of approximately thirty (30) feet to the ground below.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) On or about January 21, 2020; an employee was working on a steep-sloped roof, roofing an apartment located at 301 E Lamar St, McKinney, TX approximately thirty (30) feet or more above the ground below was not protected from a fall hazard. OSCAR RAMIREZ WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, (1926.501(B)(13), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 120207, CITATION NUMBER 01, ITEM NUMBER 002, AND WAS AFFIRMED AS A FINAL ORDER ON 04/25/2017, WITH RESPECT TO A WORKPLACE LOCATED AT 900 NETHERFIELD, MANSFIELD, TX 76063.
