29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):     On or about January 21, 2020, an employee was exposed to hazardous energy sources when performing maintenance and servicing, including but not limited on the Excel Baylor Equipment, because the employees were not effectively isolating all energy sources and the employer did not did not cover the action listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6).     Employees who performed servicing and maintenance were not required to:   (1)         Know the type and magnitude of the energy, the hazards of the energy to be controlled, and the method or means to control the energy;   (2)         Turn off and shut down the machine;  (3)         Physically locate and operate energy isolating devices in such a manner as to isolate the machine or equipment from the energy source;  (4)         Affix lockout or tagout devices to each energy isolating device,   (5)         Lockout devices shall be affixed in a manner to that will hold the energy isolating devices in a "safe" or "off" position.  (6)         Prior to starting work on machines that have been locked out or tagged out, verify that isolation and deenergization of the machine or equipment have been accomplished.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    On or about January 21, 2020, Employees operating the forklifts exposed other employees to being struck by, because the employer did not ensure each operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in paragraph (l).

29 CFR 1910.178(l)(6): The certification did not include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation:    On or about January 21, 2020, The employer did not document the required certification for operators who operator powered industrial vehicles, which would include:  the operators name, date of the training, date of the evaluation and/or the name of the person conducting the evaluation.
