OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to hazards of being struck by falling steel storage racks and/or components of the steel storage racks, including any materials stored on the racks:       a) Storage warehouse and manufacturing warehouse:       Bottoms of steel storage rack columns were not anchored to the floor with anchor bolts to support loads and resist forces from potentially being struck by moving equipment. Employees engaged in material handling operations were exposed to being struck and crushed by falling steel storage racks and/or components of the steel storage racks, including any materials stored on the racks. On or about 01/23/2020.    Abatement Note: among other methods one feasible and acceptable method to correct this hazard is to:     Follow ANSI MH16.1:2012, "Specification for the Design, Testing and Utilization of Industrial Steel Storage Racks.", under "1.4.7 Column Base Plates and Anchors", which states: "The bottom of all columns shall be furnished with column base plates, as specified in Section 7.1. All rack columns shall be anchored to the floor with anchor bolts, which shall be designed in accordance with Section 7.3, to resist all applicable forces as described in Section 2.1 or Section 2.2."      b) Storage warehouse and manufacturing warehouse:       The employer did not repair and/or evaluate the damaged portions of the steel storage racks to ensure that the racks have the structural integrity to support loads and resist forces from potentially being struck by moving equipment. Employees engaged in material handling operations were exposed to being struck and crushed by falling steel storage racks and/or components of the steel storage racks, including any materials stored on the racks. On or about 01/23/2020.    Abatement Note: among other methods one feasible and acceptable method to correct this hazard is to:     Follow ANSI MH16.1:2012, "Specification for the Design, Testing and Utilization of Industrial Steel Storage Racks.", under "1.4.9 Rack Damage", which states: "Upon any visible damage, the pertinent portions of the rack shall be immediately isolated by the user until the damaged portion is evaluated by a storage rack design professional. Before allowing the rack to be placed back into service the design professional must certify that the rack system and/or the repaired components have been restored to at least their original design capacity."
