OSH ACT of 1970 Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck-by the load: On or about January 23, 2020; and at times prior thereto; employees operated three (3) Monorail Manual Trolley 2-Ton Electric Chain Hoists, which two (2) of the hoists had malfunctioning safety latches, and one (1) had a missing safety latch that did not secure the loads on the hooks, exposing employees to being struck-by the load.
