OSH ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause serious physical harm to employees:  The employer is failing to protect employees from struck-by hazards associated with the operation of a Powered Industrial Tuck (PITS). This was most recently documented on or about January 23, 2020 in the warehouse of Airlite Plastics at 6110 Abbott Drive, Omaha, NE 68110.  An employee operated the Hyster S150A PITS which did not have a seatbelt.  ASME B56.1-1993 requires that use of an operator restraint system be provided and used on a powered industrial truck.  AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS:  (a)  Ensure that a seatbelt retrofit kit is available through the fork truck manufacturer it is installed on the vehicle.    (b) Ensure that employees are utilizing a seat belt as required by ASME B56.1-1993   (c) Replace existing equipment with equipment that is in compliance with this requirement.
