29 CFR 1926.501(b)(1): Each employee on a walking/working surface having an unprotected side or edge which was six or more feet (1.8m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest system:   a) On or about 01/24/20, at Stonebriar Glen Homes, located on 6745 Forth Section Road, in Brockport, New York, employees were working on surfaces 20 feet above lower levels without the use of fall protection. The employer did not enforce the use of fall protection.  NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a)  On or about 01/24/20, at Stonebriar Glen Homes, located on 6745 Forth Section Road, in Brockport, New York, a portable extension ladder in use was not positioned so that the side rails extended at least 3 feet above the access level. The ladder was not tied off at the top and the access point was 12 feet above the lower surface.  NO ABATEMENT CERTIFICATION REQUIRED
