OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm due to improper placement of vehicles under the SafeRack system.  a) Checkout Lane at the Scale House: On or about January 25, 2020 and times prior the employer did not ensure proper placement of vehicles/sandbox at the SafeRack Loading Rack structure for proper deployment of the SafeRack gangway system. Employees were exposed to trips, falls and struck by hazards from the improperly positioned vehicles and the improper operation of the gangway system.

The gangway stair base tread was not adjusted level with the top of the sandbox exposing employees to trip and fall hazards while attempting to climb up or down from the gangway.

29 CFR 1910.29(b)(2)(iv): The employer did not ensure that other equivalent intermediate members of guardrail systems (such as additional midrails and architectural panels) were installed so that the openings were not more than 19 inches (48 cm) wide.  a) On or about January 25, 2020 and times prior, an employee accessed the top of the sandbox to open/close the lid and collect samples.  The SafeRack's gangway cage was not adequately adjusted which resulted in a gap of approximately 2 1/2 to 3 feet between the bottom of the cage and the top of the sandbox  exposing employees to a fall of 11 feet 9 inches to the ground.
