29 CFR 1926.652(e)(2)(i): Excavation of material to a level no greater than 2 feet (.61m) below the bottom of the members of a support system was permitted where the system was not designed to resist the forces calculated for the full depth of the trench:  At a construction site located at 5100 Rockhill Rd, Kansas City, MO: Employees were exposed to struck-by and caught-in hazards. An employee was observed working in a trench that was greater than 8 feet in depth with protective systems that were not positioned to prevent material from being below the bottom support system. The materials was approximately 2.5 to 3 feet from the bottom of the support system.
