Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause serious physical harm to employees, in that employees were exposed to burns from accidental contact with hot steam pipes:     a)   On or about January 24th, 2020, and at times prior, the employer, Red Leg Brewing Company, LLC., did not ensure brewing employees were protected from severe burn hazards due to potential contact with non-insulated and, or unguarded metal steam pipes.  Metal steam pipes, at approximately 247 degrees Fahrenheit, ran horizontally from an outdoor boiler and made vertical entry into the bottom of the jacketed Minnetonka Hot Liquor Tank.  This specific section of piping ran from approximately 7 feet in height, entered the tank at approximately 3 feet from the ground.  The piping was located in front of the tank and protruded into the main walkway.

29 CFR 1910.219(d)(1): Pulley(s) with part(s) seven feet or less from the floor or work platform were not guarded in accordance with the requirements specified in 29 CFR 1910.219 (m) and (o):    a)   On or about January 24th, 2020, and at times prior, the employer, Red Leg Brewing Company, LLC., did not ensure brewing employees were protected from caught-in hazards due to an unguarded, power transmission pulley on the auger machine, which was located in the Mill Room.  Mid-point height of the pulley system was approximately 6 inches from the ground.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a)   On or about January 24th, 2020, and at times prior, the employer, Red Leg Brewing Company, LLC., did not ensure each exposed employee was provided with effective hazard communication training regarding the hazardous chemicals to which they may be exposed during the performance of tank cleaning duties.  These chemicals include, but are not limited to, nitric acid, phosphoric acid, and paracetic acid.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  a)   On or about January 24th, 2020, and at times prior, the employer, Red Leg Brewing Company, LLC., did not ensure employees were presented with basic advisory information as mentioned in Appendix D, when provided with N-95 filtering facepieces for the process of pouring grain into the auger hopper in the Mill Room.
