OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards:  a)  Loading dock area;  On or about January 28, 2020 and at times prior, employees operating forklifts were exposed to struck-by hazards due to insufficient lighting while loading / unloading trailers between sunset and sunrise hours in that no dock lights and one forklift (003) without headlights were being used.  Employees used their cellphone light or a small flashlight to enable them to see during the loading/unloading process, which reduces their ability to control the forklift with both hands during critical times, like lining up on pallets, entering/exiting the trailer and driving in reverse.

29 CFR 1910.178(l)(2)(iii): All operator training and evaluation was not conducted by persons who had the knowledge, training, and experience to train powered industrial truck operators and evaluate their performance:  a) Qualified training conducted by person with knowledge, training, and experience designated; On or before January 28, 2020 and times prior: The employer failed to ensure a designated person was assigned to conduct forklift training who had the knowledge, training, and experience to ensure all elements of the OSHA standard were properly covered and training was certified.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition:  a) Unsafe forklifts being used; On or about January 28, 2020 and times prior: The employer failed to ensure forklift 002 and 003 were taken out of service due to unsafe conditions such as the tilt locking device to hold the steering column in position thus allowing the steering column to move up/down during operation, 003 - headlights for working in trailers during night operation, 002 - dash welds broke causing whole dash to move, 002 - seat belt not locking properly which exposed operators and employees to potential hazards.
