29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the provisions specified in 29 CFR 1910.28(b)(1)(i)(A) - (C): a) At the second level storage inside the warehouse, on or about January 24, 2020, employees performing warehouse activities such as, but not limited to, picking orders and handling crated product to be stored from two open garage doors were exposed to a fall hazard of 13 feet 7 inches high , in that, no guardrail system or other fall protection system was provided.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: a) At the south warehouse next to the rail dock's door, on or about January 24, 2020, the employer had not implemented the provisions of the program for employees using N95 filtering facepiece respirators while cutting and sanding stone and tile products, exposing employees respiratory hazards.
