29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146:      1) On January 23, 2020, and at prior times, the employer had not developed and implemented a written permit space entry program, where the employer had decided its employees would enter permit required confined spaces such as the lauter tun.

29 CFR 1910.146(c)(2): The employer did not inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces:     1) On January 23, 2020, and at prior times, the employer had not posted signs warning of the danger of entering permit required confined spaces in the workplace, such as the lauter tun, mash tun, and stills.      Abatement note: A sign reading "DANGER- PERMIT REQUIRED CONFINED SPACE, DO NOT ENTER" would satisfy the requirement of this section.

29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:      1) On or about January 17, 2020, and at prior times, employees performed maintenance on equipment such as the grain mill where electrical and stored energy presented the hazard of unexpected startup.  The employer had not established a lockout/tagout program including energy control procedures and employee training.
