Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by a forklift in the event of a tip over. On or about January 27, 2020, and at times prior thereto: a. Employees operated a Clark Forklift, Model C30L without utilizing a seatbelt. b. Employees operated a Clark Forklift, Model CMP25L without utilizing a seatbelt.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. On or about January 27, 2020, and at times prior thereto, employees operated Clark forklifts throughout the facility without having completed training consisting of a combination of formal instruction, practical training, and evaluation of the operator's performance in the workplace.
