29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  a) Abel Hernandez located at 6575 Greenway Loop, Dublin, OH 43016:  On and preceding January 28, 2020, employees were installing shingles on a re-roof project of on a two story residential home at heights up to 20 feet without fall protection or PPE. The employer did not initiate and maintain safety and health programs related to the roofing work being conducted.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:   a) Abel Hernandez located at 6575 Greenway Loop, Dublin, OH 43016:  On and preceding January 28, 2020, the employer did not instruct employees in the recognition and avoidance of unsafe conditions and the procedures to be followed in order to minimize these hazards. Roofers were installing shingles with pneumatic nail guns on a roof that varied from 10-20 feet. The employees were not utilizing eye or fall protection which exposed them to falls up to 20 feet and struck by hazards to the eyes.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) Abel Hernandez located at 6575 Greenway Loop, Dublin, OH 43016:  On and preceding January 28, 2020, the employer did not ensure that employees wore eye protection while utilizing pneumatic nail guns. Workers were installing roofing shingles using pneumatic nail guns powered at 90-120 psi without the use of eye protection.  The following condition exposed employees to struck-by hazards to the eyes.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) Abel Hernandez located at 6575 Greenway Loop, Dublin, OH 43016:  On and preceding January 28, 2020, the employer did not ensure that employees engaged in residential construction activities 6 feet or more above lower level were protected from falls. Roofers were installing shingles on a roof that varied from 10-20 feet. The employees were not utilizing proper fall protection which exposed them to falls up to 20 feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) Abel Hernandez located at 6575 Greenway Loop, Dublin, OH 43016:  On and preceding January 28, 2020, the employer did not ensure that the portable ladder used to gain access to the roof extended at least three feet beyond the upper landing that they were using for access.  An extension ladder used to gain access to roof section 10-11 feet high was positioned 10 inches beyond the eave of the roof.  The following condition exposed employees to falls up to 11 feet.
