29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:    At 317 Morning Line Drive, Naples, Florida, 34102: On or about 1/21/2020 and at times prior, the employer did not develop and implement an accident prevention program that included the following elements: management commitment and employee involvement; worksite analysis; hazard prevention and controls; and safety and health training,   to ensure that employees were protected from struck-by, fire, burn, and explosion hazards when engaged in construction activities associated with the operation of gasoline powered chop-saws.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a. At 317 Morning Line Drive, Naples, Florida, 34102: On or about 1/21/2020 and at times prior, an employee was operating a gasoline powered chop-saw to cut a cast iron pipe, during which the employer had not instructed the employee in the recognition and avoidance of kick-back hazards from the saw; thereby exposing the employee to a struck-by and laceration hazards.  b. At 317 Morning Line Drive, Naples, Florida, 34102: On or about 1/21/2020 and at times prior, an employee was operating a gasoline powered chop-saw to cut a cast iron pipe, during which the employer had not instructed the employee in the recognition and avoidance of the gasoline auto-ignition temperature/hazard while refueling the saw; thereby exposing the employee to a fire, burn, and explosion hazards.

29 CFR 1926.302(c)(1): All fuel powered tools shall be stopped while being refueled, serviced, or maintained, and fuel shall be transported, handled, and stored in accordance with Subpart F of this part.    At 317 Morning Line Drive, Naples, Florida, 34102: On or about 1/21/2020 and at times prior, an employee was refueling a gasoline-powered chop-saw, without first allowing the saw engine and engine exhaust to cool down; and without removing the fuel tank filler cap carefully, to allow gasoline vapors to release slowly from the tank, thereby exposing the employee to a fire, burn and explosion hazard.
