29 CFR 1926.95(d)(1): Except as provided by paragraphs (d)(2) through (d)(6) of this section, the protective equipment, including personal protective equipment (PPE), used to comply with this part, was not provided by the employer at no cost to employees: On or about January 27, 2020 the employer did not provide employees with personal protective equipment to protect them from a fall hazard and required employees to purchase and use fall protection equipment. In the alternative: 29 CFR 1910.132(h)(1): The employer did not provide employees with personal protective equipment (PPE) that was required to protect employees from hazards and required employees to purchase and use their own PPE.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: (a) This violation occurred on or about January 27, 2020 over the stage where employee working within the roof trusses were exposed to a fall hazard. In the alternative: 29 CFR 1910.28(b)(15): Walking-working surfaces not otherwise addressed. Except as provided elsewhere in this section or by other subparts of this part, the employer did not ensure each employee on a walking-working surface 4 feet (1.2m) or more above a lower level was protected from falling by: (i) Guardrail systems; (ii) Safety net systems; or (iii) Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems.
