29 CFR 1903.19(d)(1): The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  For Citation 2, Item 2, issued on 5/1/2020 with an abatement date of 5/29/2020, the employer did not provide documents demonstrating the complete abatement of the citation violation to OSHA.

29 CFR 1926.1053(b)(22): Employees using ladders were carrying objects or loads that could cause the employee to lose balance and fall:  On or about 1/22/2020, the employer did not ensure that employees, using portable ladders, did not carry loads up the ladder.  Workers performing commercial roofing operations were exposed to falling approximately ten (10) feet when they carried twelve (12) foot sheets of roofing material up the roof, on the ladder.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  On or about 1/22/2020, the employer did not ensure fall protection was implemented for employees performing commercial roofing operations on a newly constructed structure.  The employees were exposed to fall hazards of approximately ten (10) feet.  Jose Rocha Arias was previously cited for a violation of an equivalent occupational safety and health standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1101114, citation number 1, item number 2 and was affirmed as a final order on 12/4/2015, with respect to a workplace located at 1540 Pheasant Ridge, Ellisville, MO, 63011.

29 CFR 1926.1053(b)(1): Portable ladders are used for access to an upper landing surface and the ladder side rails do not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access:    On or about 1/22/2020, the employer did not ensure portable ladders were constructed and placed so three (3) feet or more was extended above the upper landing.  Workers performing commercial roofing operations were exposed to falling approximately ten (10) feet while using an extension ladder to ascend/descend from the ground level to the roof.  Jose Rocha Arias was previously cited for a violation of this equivalent occupational safety and health standard, 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1101114, citation number 1, item number 3 and was affirmed as a final order on 12/4/2015, with respect to a workplace located at 1540 Pheasant Ridge, Ellisville, MO, 63011.
