OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, the foreman was exposed to fall, struck by and caught in-between hazards while using the bucket of a Samsung excavator to enter and exit a 10 foot deep excavation that had vertical walls and no cave-in protection.      On or about 01/29/2020 at the Danbury Road Construction Project,  the foreman was riding the excavator bucket to enter and exit a 10 foot deep excavation with no sloping or cave-in protection.

29 CFR 1926.651(j)(1): Adequate protection was not provided to protect employees from loose rock or soil that could pose a hazard by falling or rolling from an excavation face:    On or about 01/29/2020 at the Danbury Road Construction Project, the foreman and employee were working in a 10 foot deep excavation and were not protected from struck by hazards from the soil and rocks in the walls of the excavation as well as the spoil pile located at the edge of the excavation.
