29 CFR 1910.28(b)(1)(i)(C): Employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling through the use of a personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems:   a) Distribution Center Pallet Flow Racking System: On or about January 29, 2020, and at times prior thereto; Forklift operators of Raymond 740R45TT reach trucks and Raymond pacer trucks have been unhooking from their safety belts and harnesses in order to clear pallet jams that happen as a result of misaligned product.  Employees are exposed to a 3-20 foot fall hazard once they unhook and work to clear jams that are close to the edge of the rack system, and/or exposed to a trip or caught-in hazard while pallet rack rollers are moving as they climb into the live flow system.   Note* Abatement certification IS required for this item.

29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck.  a) On or about February  28, 2020, and at times prior thereto; employer allowed a PIT operator to operate various forklift models to include a Raymond 740R45TT, SN 74005CA2719, stand-up reach truck, exposing employee to struck-by hazards and caught-in hazards where employee did not have knowledge and familiarity with that truck's specific foot controls and stopping distance.  Note* Abatement certification IS required for this item.

29 CFR 1910.178(l)(6): The employer did not certify that each operator has been trained and evaluated as required by this paragraph:  a) On or about January 28, 2020 and at times prior thereto; while driving a Raymond 740R45TT, SN 74005CA2719, stand-up reach truck, an operator misjudged a parked rental forklift, Raymond 425, SN 425-18-57926 in the battery charging service area of the manufacturing building, causing his truck to strike the rental. Employee's foot caught between the rental and the forklift the employee was operating; resulting in injury to the left ankle. The Raymond 740R45TT, SN 74005CA2719 was not a forklift which the employee drove on a routine or periodic basis.  Employer did not ensure operator had taken the written test, or document certification of the operator.        Note* Abatement certification IS required for this item.
