29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: The employer is failing to ensure that the employees working at heights greater than 6 feet are using fall protection. Employees were observed shoveling snow from a flat roof were not protected from falling. This was most recently documented on January 27, 2020 at North Brook Apartments, located at 1825 NW Radial Highway, Omaha, Nebraska.
