29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) Ronan Body Shop, Towing and Repair, Ronan, MT: On or about January 30, 2020, and at times prior, employees were exposed to respiratory hazards while wearing a half mask elastomeric respirator to perform spray operations. The employer failed to ensure all employees had a medical evaluation prior to respirator use.

29 CFR 1910.134(f)(2): Employee(s) using a tight-fitting facepiece respirator were not annually fit tested: a) Ronan Body Shop, Towing and Repair, Ronan, MT: On or about January 30, 2020, and at times prior, employees were exposed to chemical hazards while wearing a half mask elastomeric respirator and using Methylene diphenyl Disocyanate, Propanol, and Polyethylene Polyphenol Isocyanate (UL LP 23 A) during bed liner spraying operations. The employer failed to ensure that employees were annually fit tested.
