29 CFR 1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written certification record:  475 College Highway, Southwick, MA: On or about January 29, 2020, the employer did not verify compliance with paragraph (a) of this section by preparing a written certification record for employee fall protection training.  The employer routinely fails to assure effective protection against falls as required by the standard, as demonstrated on January 29, 2020, when employees were installing shingles on a residential roof located at 475 College Highway, Southwick, MA with out fall protection. Employees were exposed to fall hazards of more than 15 feet above the next lower level (ground).     Cesar Lopez  was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.503 (b) 1 which was contained in OSHA inspection number 125295, citation number 1, item number 1b and was affirmed as a final order on 9/15/2017, with respect to a workplace located at 17 Leete St., Springfield, MA.  Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29CFR1903.19(d)(1).

29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access:  475 College Highway, Southwick, MA: On or about January 29, 2020, employees were observed using portable ladders to reach the upper landing surface (roof) that did not extend 3 feet past that upper landing surface.  The employer routinely fails to assure effective protection against falls as required by the standard, as demonstrated on January 29, 2020, when employees were using ladders that did not extend 3 feet past the upper landing of the residential roof work area  located at 475 College Highway, Southwick, MA with out fall protection. Employees were exposed to fall hazards of more than 15 feet above the next lower level (ground).     Cesar Lopez  was previously cited for a repeat violation of this occupational safety and health standard 29 CFR 1926.1053 (b) 1 which was contained in OSHA inspection number 122643, citation number 1, item number 3 and was affirmed as a final order on 7/17/2017, with respect to a workplace located at 17 Lindale St., Springfield, MA.  Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29CFR1903.19(d)(1).

29 CFR 1926.501(b)(11):  Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  475 College Highway, Southwick, MA: On or about January 29, 2020, 4 employees were observed roofing this steep roof without any fall protection.   The employer routinely does not assure effective protection against falls as required by this or equivalent  standard(s), as demonstrated on October 1, 2019, when employees were installing shingles on a residential roof located at 94 Westmoreland Ave., Longmeadow, MA without fall protection. Employees were exposed to fall hazards of more than 11 feet above the next lower level (ground).  Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29CFR1903.19(d)(1).
