29 CFR 1910.178(m)(5)(i): When a powered industrial truck is left unattended, load engaging means were not fully lowered, controls were not neutralized, power was not shut off, and brakes set: Instance 1. On or about January 30, 2020 and at times prior thereto, Forklifts Operators would exit the Powered Industrial Truck (PIT), leaving it powered on and operational, while they would enter the dispatch office to collect and/or turn in work orders, exposing employees to the hazards of an unattended PIT. Instance 2. On or about January 30, 2020 and February 5, 2020 and at times prior thereto, Forklift Operators were observed at a distance greater than 25 feet away from their forklift while it was powered on an operational, exposing employees to the hazards of an unattended PIT. Instance 3. On or about February 5, 2020 and at times prior thereto, Forklift Operators staged their forklifts at the end shift, powered off, with the load engaging means not fully lowered, exposing employees to the hazard of an unattended PIT.

29 CFR 1910.178(n)(7)(iii): On all grades the load and load engaging means shall be tilted back if applicable, and raised only as far as necessary to clear the road surface. Instance 1. On or about January 30, 2020 and at times prior thereto, forklift operators had their Powered Industrial Truck (PIT) load engaging means raised above the overhead guard so that loads could fit through stacked lumber supplies while traveling to next destination, exposing employees to the hazards of a off balanced PIT. Instance 2. On or about February 5, 2020 and at times prior thereto, forklift operators had their Powered Industrial Truck (PIT) load engaging means raised above the overhead guard while carrying a load and traveling through the yard to next destination, exposing employees to the hazard of a off balanced PIT.
