OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:       a)  Tire warehouse: On or about 2/3/2020, and at times prior, employees were exposed to struck by hazards, in that the racking system used to store tires in the warehouse was unstable and not being used as designed. The racking has the potential to tip over or collapse. The racking system is 3 to 4 units high with each unit approximately 5 feet in height.

29 CFR 1910.23(b)(10): The employer did not ensure any ladder with structural or other defects was immediately tagged "Dangerous: Do Not Use" or with similar language in accordance with 1910.145 and removed from service until repaired in accordance with 1910.22(d), or replaced.       a)   Tire Warehouse:  On or about 2/3/2020, and at times prior, the employer exposed employees to fall hazards, in that he failed to conduct prior to use inspections of ladder stands and take them out of service when found damaged. Fully functional ladder stands were not provided to employees while removing stock from racking systems.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:        a)   Tire Warehouse:  On or about 2/3/2020, and at times prior, the employer exposed employees to corrosive hazards, in that an eye wash station was not provided to employees while charging and filling a flooded industrial forklift battery. Flooded batteries contain sulfuric acid which is a highly corrosive substance.

29 CFR 1910.178(g)(2): Facilities were not provided for flushing and neutralizing spilled electrolyte, for fire protection, for protecting charging apparatus from damage by trucks, and/or for adequate ventilation for dispersal of fumes from gassing battery.      a)   Tire Warehouse:  On or about 2/3/2020, and at times prior, the employer exposed employees to physical and respiratory hazards, in that there was no adequate ventilation, no means to neutralize acid and no PPE provided after the installation of the flooded battery charger. The employees were required to check the water level in the battery and fill as needed and to place the unit on the charger.

29 CFR 1910.303(b)(1): Electrical equipment was not free from recognized hazards that were likely to cause death or serious physical harm to employees:        a)   Tire Warehouse:  On or about 2/3/2020, and at times prior, the employer exposed employees to electrical hazards, in that electrical outlets were hanging out of junction boxes and other electrical boxes were showing bare live parts that could cause electrical shock or death to employees working in close proximity to them. These were located in various places throughout the warehouse area where employee are engaged in loading and unloading tires.

The hospitalization was revealed during the inspection on February 3, 2020.

Employees work in a tire warehouse where they load and unload tires. The fire extinguisher are located on all 4 walls and in every row of racks.
