29 CFR 1926.602(d): The employer did not ensure that each employee operating a powered industrial vehicle had been trained and evaluated as required by paragraph 29 CFR 1910.178(l): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178 and as referenced by the note contained in 1926.602(d). a) Jobsite - On or about February 3, 2020, employees were permitted to operate a Caterpillar TH63 telehandler and had not been evaluated once every three years. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
