29 CFR 1926.454(c)(3): The employer failed to retrain employees that showed indications through work performance of not retaining the requisite proficiency: (a) Jobsite: On or about February 4, 2020, an employee was working from (standing on) a pallet of concrete blocks that were on tubular welded frame scaffolding and he was not protected from falling. The employee needs to be retrained in the safe methods to minimize fall hazards when erecting scaffolding. The fall hazard to the employee was about 45 feet.

29 CFR 1926.1417(w): 29 CFR 1926.1417(w): The employer did not use a tag or restraint line when necessary to prevent rotation of the load that would be hazardous: (a) Jobsite: On or about February 4, 20120, the employer was lifting a load of scaffold planking that did not have tag lines on it. According to the employee the load was spinning when it was being landed.
