29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part. a. Located at Lot 36 Springcreek Drive in Pickerington, Ohio: On or about February 5, 2020, the employer did not maintain an effective safety and health program to ensure hazards associated with trenching work were identified and corrected onsite. Employees were not trained on the cave in protection requirements.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated. a. Located at Lot 36 Sringcreek Drive in Pickerington, Ohio: On or about February 5, 2020, the employer did not ensure that the trench was inspected to ensure proper benching systems were in place and to identify possible cave in hazards prior to an employee accessing the trench to locate the utility tap.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section. a. Located at Lot 36 Sringcreek Drive in Pickerington, Ohio: On or about February 5, 2020, the employer did not ensure that an adequate protective system was in place to prevent cave-in hazards for employees performing work in the trench, thereby exposing an employee to a crushed by hazard.
