OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees the employer did not ensure that municipalities delivering municipal recyclables received a written copy of tipping floor safety rules and were regularly informed of observed violations:  a. 1 Linden Avenue E, Jersey City, NJ (Yard)  Employer did not ensure that municipalities delivering municipal recyclables received a copy of tipping floor safety rules that specify that trucks should not proceed to the tipping floor or move in reverse without observing and receiving instructions from the Traffic Controller on site.  The employer shall review and update its procedures for reporting observed violations by municipal recycling drivers, ensure that employees who report observed violations receive feedback, and work with municipalities to address repeat violators.  On 01/24/2020, an employee sustained an injury when he was struck by a municipal recyclables vehicle which proceeded into the area in front of the tipping floor when the Traffic Controller was not present, and moved into reverse without receiving instruction to do so from the Traffic Controller.
