29 CFR 1910.30(a)(3): The employer did not train each employee in at least the following topics: The nature of the fall hazards in the work area and how to recognize them; the procedures to be followed to minimize those hazards; the correct procedures for installing, inspecting, operating, maintaining, and disassembling the personal fall protection systems that the employee uses; and the correct use of personal fall protection systems and equipment specified in paragraph (a)(1) of this section, including, but not limited to, proper hook-up, anchoring, and tie-off techniques, and methods of equipment inspection and storage, as specified by the manufacturer.    On or about February 6, 2020, employees of General Beverage Sales Company, Inc who are exposed to fall hazards while working from Raymond Order Pickers at heights of up to 30 feet were not trained in requirements of the standard including nature of fall hazards, fall hazard recognition, procedures for inspecting and maintaining fall protection equipment and the correct use of the fall protection equipment.

29 CFR 1910.132(a): Application. Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.    General Beverage Sales Company, Inc. is not ensuring that each employee assigned to wear harnesses while working in, and from, Raymond Order Pickers are using the harnesses and wearing them correctly.

29 CFR 1910.176(b): Secure storage. Storage of material shall not create a hazard. Bags, containers, bundles, etc., stored in tiers shall be stacked, blocked, interlocked and limited in height so that they are stable and secure against sliding or collapse.    On or about February 6, 2020, employees were exposed to stuck-by hazards:    a) when section 02 of storage racking was not securely anchored to the floor.    b) when section 06 of storage racking was not securely anchored to the floor and showed damage to uprights near 06108 and 06112 where the vertical members had been bent.    c) when section 08 of storage racking was not securely anchored to the floor and showed damage near 08107 where a significant dent could be seen near the column base plate and the upright near 08108  where the vertical member had been bent.    d) when section 12 of storage racking was not securely anchored to the floor and showed damage to an upright near 120114 where a significant dent could be seen near the column base plate.    e) when section 13 of storage racking was not securely anchored to the floor.    f) when section 18 of storage racking was not securely anchored to the floor.    g) when section 45 of storage racking was not securely anchored to the floor.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly.    On or about February 5, 2020, the Toyota Model 8FGCU25 forklift (Serial No. 46630) did not have a plate, tag or decal which indicated the maximum capacity, operation and maintenance instructions for employees operating the lift with the Cascade Model 35D-CCS-35A Clam attachment.

29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).    On or about February 6, 2020, General Beverage Sales Company, Inc. did not ensure that each employee tasked with operating a Powered Industrial Vehicle (PIV) in their Oshkosh facility had successfully completed training covering all elements of the standard.
