29 CFR 1910.1000(b)(1): Employee(s) were exposed to an airborne concentration of mercury listed in Table Z-2 in excess of the 8 hour Time Weighted Average concentration of 0.1mg/m3. a.) On March 4, 2020, an employee torch cutting in area S-8 of W.M. Mercury, located at 21211 Durand Avenue Union Grove, Wisconsin 53182, was exposed to 0.1549 mg/m3 of mercury over a sampling period of 310 minutes, approximately 1.54 times the limit of 0.1mg/m3. Exposure calculations included a zero increment for the 170 minutes not sampled. b.) On March 4, 2020, an employee on fire watch for the torch cutting that was occurring in area S-8 of W.M. Mercury, located at 21211 Durand Avenue Union Grove, Wisconsin 53182, was exposed to 0.1518 mg/m3 of mercury over a sampling period of 312 minutes, approximately 1.51 times the limit of 0.1mg/m3. Exposure calculations included a zero increment for the 168 minutes not sampled.

29 CFR 1910.1000(e): Feasible administrative or engineering controls were not determined and implemented to achieve compliance with the limits prescribed in 29 CFR 1910.1000(a) through (d). a.) On March 4, 2020, an employee torch cutting a turbine with traces of mercury in area S8 of W.M. Mercury at 21211 Durand Avenue, Union Grove, Wisconsin, 53182, was exposed to 0.1549mg/m3 of mercury over a sample period of 310 minutes, approximately 1.54 times the limit of 0.1mg/m3. Exposure calculations included a zero increment for the 170 minutes not sampled. The existing control measures, including administrative and engineering controls, were not adequate to limit the exposure of employees to mercury to or below the PEL. b.) On March 4, 2020, a welding apprentice assisting an employee torch cutting a turbine with traces of mercury in area S8 of W.M. Mercury at 21211 Durand Avenue, Union Grove, Wisconsin, 53182, was exposed to 0.1518mg/m3 of mercury over a sample period of 312 minutes, approximately 1.51 times the limit of 0.1 mg/m3. Exposure calculations included a zero increment for the 168 minutes not sampled. The existing control measures, including administrative and engineering controls, were not adequate to limit the exposure of employees to mercury to or below the PEL.

29 CFR 1910.252(c)(10): Welding or cutting indoors or in a confined space involving metals coated with mercury-bearing materials, including paint, was not done using local exhaust ventilation or airline respirators, when atmospheric tests under the most adverse conditions had not established that the workers' exposure was within the acceptable concentrations: (a) Within section S8 of W.M. Mercury Plant located at 21211 Durand Avenue, Union Grove, Wisconsin 53182, employee(s) were torch cutting a turbine with traces of mercury with no local exhaust ventilation or airline respirators. On March 4, 2020, an employee torch cutting a turbine with traces of mercury was exposed to 0.1549 mg/m3 of mercury over a sampling period of 310 minutes, approximately 1.54 times the limit of 0.1mg/m3. Exposure calculations included a zero increment for the 170 minutes not sampled. A second employee, who was on fire watch for the employee torch cutting, was exposed to 0.1518 mg/m3 of mercury over a sampling period of 312 minutes, approximately 1.51 times the limit of 0.1mg/m3. Exposure calculations included a zero increment for the 168 minutes not sampled. Both employees were wearing full-face respirators with mercury-vapor cartridges.
