Section 5(a)(l) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to the hazard of being struck-by equipment.     On or about February 6, 2020, employees operated a compact track loader with a bucket attachment to drive fence posts into the ground while employee(s) stood at or beneath the bucket.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    On or about February 6, 2020 at the worksite, employees were exposed to a struck-by hazard when installing fencing using a track loader without wearing protective helmets.
