29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: (a) Travel lane area of work yard: On or about 02/7/2020, and at times prior, the employer exposed employees to struck-by hazards, in that they were using a clamp attachment on a Yale propane forklift without the prior approval of the manufacturer. The forklift and attachment were used to lift and carry bags of recycled tire materials to be loaded on trucks.

1910.178(n)(8) Under all travel conditions the truck was not operated at a speed that would permit it to be brought to a stop in a safe manner. a) Roads inside compound: On or about 2/7/2020, and at times prior, the employer exposed employees to struck by hazards, in that forklift operators were not required to drive in reverse when loads they were transporting were blocking their forward view of the travel during loading and unloading.

Forklifts are used to transport recycled tire materials between loading areas and the main building.
