29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:  (a) Kassa's Liquor Store, Roof: On or about 02/07/2020, and at times prior, the employer exposed employees to struck-by hazards while operating pneumatic framing nail guns, in that protective eyewear was not provided to employees engaged in framing and sheathing activities. Employees were exposed to wood debris, plastic collated fragments and 2-3/8-inch fasteners.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  (a) Kassa's Liquor Store, Roof: On or about 02/07/2020, and at times prior, the employer exposed employees to fall hazards of 8-feet, 8-inches to the lower level, in that a fall protection system was not used while engaged in plywood sheathing activities on a 4/12 pitched roof.   (b) Kassa's Liquor Store, Roof: On or about 02/07/2020, and at times prior, the employer exposed employees to fall hazards of 11-feet, 11-inches to the lower level, in that a fall protection system was not used while engaged in plywood sheathing activities on a 6/12 pitched roof.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a) Kassa's Liquor Store, Roof: On or about 02/07/2020, and at times prior, the employer exposed employees to fall hazards of 8-feet, 8-inches to the lower level, in that the ladders used to access the roof and the lower level were not extended at least 3-feet past the eave to allow employees safe access.  (b) Kassa's Liquor Store, Roof: On or about 02/07/2020, and at times prior, the employer exposed employees to fall hazards of 11-feet, 11-inches to the lower level, in that the ladders used to access the roof and the lower level were not extended at least 3-feet past the eave to allow employees safe access.

29 CFR 1926.403(b)(1): Examination. The employer shall ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees. Safety of equipment shall be determined on the basis of the following considerations:  (a) Kassa's Liquor Store, Roof: On or about 02/07/2020, and at times prior, the employer failed to inspect all electrical cords and equipment prior to the start of the shift, in that the DeWalt Air Compressor cord had a damaged strain relief and was not repaired or removed from service prior to the start of the shift.
