29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. On or about February 10, 2020, on the roof of a residential home being constructed, where employees was exposed to struck by hazards while operating a nail gun without safety eye protection.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b). On or about February 10, 2020 on the residential construction site, employees were exposed to a fall hazard greater than 6 feet when performing roofing work without a fall protection system. Rutilo Garcia was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1387484, citation number 1 item number 1 and was affirmed as a final order on April 8, 2019 with respect to a workplace located at 6807 Andorra Cove Cir., Katy, TX 77493.
